  4. THIS IS A LEGAL AGREEMENT BETWEEN YOU, THE END USER, AND 
  5. FARALLON  COMPUTING, INC. ("FARALLON").  CLICKING THE 
  6. "ACCEPT" BUTTON  OR USING THE  ACCOMPANYING COMPUTER
  7. SOFTWARE (THE "SOFTWARE") INDICATES  THAT YOU AGREE TO
  8. BE LEGALLY BOUND BY THIS AGREEMENT AND COMPLY WITH ITS 
  9. TERMS. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE CLICK
  10. THE "DO NOT ACCEPT" BUTTON AND DO NOT USE THE SOFTWARE.

  12. *  GRANT OF LICENSE. Farallon grants to you a non-exclusive, personal
  13. license to use the Software as provided in this License for evaluation and trial
  14. use purposes only. This Software will cease to function after a pre-determined 
  15. time interval.

  17. *  COPYRIGHT. The Software is owned by Farallon or its suppliers and is 
  18. protected by United States copyright laws and international treaty provisions.
  19.  
  20. * OTHER RESTRICTIONS. You may not attempt to defeat the "time-out" 
  21. nature of the Software. You may not modify, reverse engineer, decompile, 
  22. disassemble, or create derivative works from the Software or accompanying 
  23. documentation (the "Documentation").

  25. * TERM. This License is effective until terminated. You may terminate
  26. the license at any time by returning the Software and all Documentation to 
  27. Farallon and by removing the Software from the memory of the computer into 
  28. which the Software has been transferred. This License may be terminated by 
  29. Farallon immediately and without notice in the event that you fail to comply
  30. with any term or condition hereof. Upon any termination, you will return to 
  31. Farallon, at your expense, the Software and Documentation and any copies 
  32. whether or not the copying was authorized.

  34. *  GOVERNMENT LICENSEE. The Software and Documentation are provided
  35. with  Restricted Rights. Use, duplication, or disclosure by the U.S. 
  36. Government is subject to restrictions as set forth in the Rights in Technical
  37. Data and Computer Software clause at DFARS 252.227-7013 and the Commercial 
  38. Software-Restricted Rights Clause at  48 CFR  52.227-19. Manufacturer is 
  39. Farallon Computing, Inc. 2470 Mariner Square Loop, Alameda, California 94501.

  41. * EXPORT LAW ASSURANCES. You agree that neither the Software nor any
  42. direct product thereof is being or will be acquired, shipped, transferred, 
  43. or reexported, directly or indirectly, into any country  prohibited by the 
  44. United  States  Export Administration Act and the regulations thereunder or 
  45. will be used for any purpose prohibited by the same.

  47. *  SEVERABILITY. If for any reason, any provision or partial 
  48. provision of this License is held invalid, such invalidity shall not 
  49. affect the remainder of such provision or this License, and this License
  50. shall, to the full extent consistent with law, continue in full force and 
  51. effect.

  53. *  THIRD PARTY BENEFICIARIES. If any portion of the Software has been
  54. licensed to Farallon by a third party for redistribution, Licensee is 
  55. hereby notified that such third party is an intended third party 
  56. beneficiary of this License with full rights of enforcement.

  58. * GENERAL. The validity and performance of this License shall be 
  59. governed by California law, except for that body of  law dealing with 
  60. conflict of laws and except as to copyrights, which are governed by 
  61. United States laws and international treaties. This License constitutes 
  62. the entire agreement between the parties concerning the subject matter
  63. hereof. Any waiver or amendment of any provision of this License shall 
  64. be effective only if in writing and signed by you and an officer of 
  65. Farallon. No distributor, dealer, or employee (other than an officer) 
  66. of Farallon is authorized to change or amend any terms of this License.
  67. In the event of any conflict between the terms of this License and the
  68. terms of any license bound into any manual packaged with the Software, 
  69. this License shall govern.

  71. * DISCLAIMER OF WARRANTY. 
  72. THIS SOFTWARE IS PROVIDED GRATUITOUSLY BY FARALLON. 
  73. ACCORDINGLY IT IS PROVIDED TO YOU "AS-IS" WITHOUT EXPRESS
  74. OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING WARRANTIES
  75. OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE OR
  76. NONINFRINGEMENT. FARALLON DOES NOT REPRESENT OR WARRANT 
  77. THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT 
  78. OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR 
  79. ERROR-FREE.

  81. * LIMITATION OF REMEDIES.
  82. BECAUSE THIS SOFTWARE IS PROVIDED TO YOU GRATUITOUSLY, 
  83. IN NO EVENT WILL FARALLON, ITS LICENSOR(S) AND THE 
  84. DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS OF ANY OF THEM 
  85. BE LIABLE TO YOU FOR ANY DAMAGES OF ANY KIND UNDER ANY 
  86. THEORY OF LIABILITY SUFFERED BY YOU OR ANYONE ELSE 
  87. ARISING OUT THE USE OR INABILITY TO USE THE SOFTWARE 
  88. EVEN IF FARALLON OR ITS LICENSOR(S) HAVE BEEN ADVISED 
  89. OF THE POSSIBILITY OF SUCH DAMAGES. FARALLON WILL NOT 
  90. SUPPORT THIS SOFTWARE AND WILL NOT ISSUE UPDATES TO 
  91. THIS SOFTWARE.
